The Mental Capacity Act 2005 implemented in April 2007 provides a statutory right to advocacy to people over the age of 16, who are un-befriended and who lack the capacity to make issue-specific decisions about:
serious medical treatment
a long-term care move
at the time at which these decisions have to be made.
In addition an IMCA may be involved in
care reviews
or
adult protection procedures.
Reference should be made to the Mental Capacity Act Code of Practice or Wiltshire & Swindon Safeguarding Vulnerable Adults procedures in these cases.
