Referrals can be made by anyone but authorisation will be sought by the IMCA from the decision-maker prior to becoming involved. It is essential that an assessment for an individual 'lacking capacity' to make time-specific decisions has been made prior to the referral, by following Department of Health guidelines. Ref: Mental Capacity Act 2005 'Code of Practice' chapter 4.
The referral can be faxed, posted or phoned to SWAN. (Or download a referral form).
In the case of serious medical treatment, the decision maker will be the consultant or person responsible for making the medical decision and for a long-term care move, it will be the care manager/local authority.
